1. Acceptance of Terms

By accessing or using EVANDALIZE (the “Service”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. It is that simple. We will not chase you down.

We may update these terms from time to time. Continued use of the Service after changes constitutes acceptance of the revised terms. We will make reasonable efforts to notify users of material changes via the dashboard or email.

2. Description of Service

EVANDALIZE is an adversarial CAPTCHA service that verifies users through satirical image defacement challenges. The Service is provided as a security tool and a work of political satire protected under the First Amendment of the United States Constitution.

The Service includes a client-side widget, a REST API for challenge creation and verification, and a dashboard for managing API keys and viewing analytics. EVANDALIZE does not guarantee the prevention of all unauthorized access. It is one layer in your security stack, not a magic wall.

3. Fair Use of Images

All images of public figures displayed within EVANDALIZE challenges are used under the fair use doctrine for purposes of political satire and commentary. Images are sourced from publicly available material.

No defaced images are stored, cached, or redistributed by the Service. Defacement occurs entirely in the client browser. Once the challenge session expires, the canvas data is discarded. We do not keep a gallery of your creative contributions, no matter how inspired they may be.

4. Acceptable Use

You agree not to:

• Use the Service for any purpose that violates applicable law in your jurisdiction
• Attempt to reverse engineer, decompile, or extract source code from the Service
• Interfere with, disrupt, or place an unreasonable load on the Service or its infrastructure
• Resell, sublicense, or redistribute access to the API without written permission
• Use automated tools to bypass or circumvent verification challenges
• Misrepresent the Service as providing military-grade security. It is a CAPTCHA, not a missile defense system.

5. API Usage and Rate Limits

API access is governed by your plan tier. The free tier includes 100 verifications per hour. Exceeding your rate limit will result in HTTP 429 responses until the limit resets. We do not throttle silently; you will know.

API keys are confidential. You are responsible for securing your secret key. If you believe your key has been compromised, rotate it immediately via the dashboard. We are not responsible for unauthorized usage resulting from exposed keys.

We reserve the right to suspend or revoke API access for any account that abuses the Service, generates excessive failed verifications, or uses the API in a manner inconsistent with its intended purpose.

6. User Accounts

To access the dashboard and API, you must create an account with a valid email address. You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us promptly of any unauthorized use of your account.

We reserve the right to suspend or terminate accounts that violate these terms, remain inactive for an extended period, or are associated with abusive behavior.

7. Intellectual Property

The Service, including its design, code, documentation, and branding, is the property of EVANDALIZE and its creators. You are granted a limited, non-exclusive, revocable license to use the Service in accordance with these terms. This license does not transfer any ownership rights.

8. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or capable of stopping every state-sponsored hacker on the planet. We are doing our best. So should you.

9. Limitation of Liability

To the maximum extent permitted by applicable law, EVANDALIZE and its creators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

• Your use of or inability to use the Service
• Any unauthorized access to or alteration of your transmissions or data
• Any third-party conduct or content on the Service
• Any security breach that the Service failed to prevent

Our total cumulative liability shall not exceed the amount you paid us in the twelve months preceding the claim, or $100 USD, whichever is greater.

10. Termination

We may terminate or suspend your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (limitation of liability, disclaimers, intellectual property) will survive.

You may terminate your account at any time by contacting us. We will delete your account data within 30 days of the request.

11. Governing Law

These terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these terms or the Service shall be resolved in the courts of competent jurisdiction.
